House Bill 197 was designed to address "pay for play sex" in the massage industry as well as trafficking concerns. It goes into effect July 1st, 2024. Expect the DOH (department of health) to begin inspecting and enforcing compliance across the state of Florida.
The bill requires the business to collect certain information from the customer prior to beginning a session. The required information includes "the full legal name, home address, and telephone number of the client or patient" (quoted from the bill).
The short answer is no. There is no language in the bill that "requires" the client provide photo identification. The only reference in the bill regarding this is; "A copy of the client's or patient's photo identification MAY be used". The operative word is "MAY" and in this context is interpreted as a suggestion or recommendation. Spa Pass simplifies the transfer of client information to the Spa.
The language in the bill regarding confirmation is: "The establishment must confirm the identification of the client". By definition, confirm means to establish the accuracy of something that has already been stated. The "Spa Pass" feature for clients solves this by using a confirmation PIN. In other cases the spa could enter the information and ask the customer to review and confirm verbally with a "Yes" that the information was entered correctly.

Spa Pass is a free account for clients to manage their full name, address and phone number. The client can grant the spa access to their information to start a session. The spa will give the client a 5 digit (confirmation) PIN to enter into their phone and it will prompt the client to agree to seamlessly pass their information into the required session log.
Yes you can delete your spa pass account. Once you delete your account, ALL your personal information and any other account information will be deleted from the Spa Pass feature. However, when you grant the spa access to your information to begin a session, a log entry is recorded with your information that will stay in the system for 1 calendar year. Every session log entry older than 365 days of the session date will have the personal information deleted from the log.
